The Republican Primary Election Challenge Alleging "Voting Irregularities" In Hindsight

I continue to be bothered by the strategy chosen by Larry Miskel and his attorney P. Dennis Barks when they challenged the 16 vote margin in the recent Republican primary election for Gasconade County Presiding Commissioner.  When I read and reread RSMO 115.601 (copied and pasted hereinbelow), I conclude that the election challenge should have been based upon the "less than one percent difference in vote" (actually a 0.57% of the total votes cast - 2788) rather than upon alleged voting irregularities in certain precincts.  It seems to me there would have been much less "burden of proof" had the point of law regarding vote difference of less than one percent been pursued in the election contest rather than the allegation that "voting irregularities" had occurred in certain precincts.

You read the statute and tell me what you think it says.  If there are any attorneys out there, you are most welcome to comment.  What am I missing here?

115.601. Recount authorized when less than one percent difference in vote—recount, defined.—

  1. Any contestant in a primary or other election contest who was defeated by less than one percent of the votes cast for the office and any contestant who received the second highest number of votes cast for that office if two or more are to be elected and who was defeated by less than one percent of the votes cast, or any person whose position on a question was defeated by less than one percent of the votes cast on the question, shall have the right to a recount of the votes cast for the office or on the question.
  2. In cases where the candidate filed or the ballot question was originally filed with an electio authority as defined in section 115.015, such recount shall be requested in accordance with the provisions of section 115.531 or 115.577 and conducted under the direction of the court or the commissioner representing the court trying the contest according to the provisions of this subchapter.
  3. In cases where the candidate filed or the ballot question was originally filed with the secretary of state, the defeated candidate or the person whose position on a question was defeated by less than one percent of the votes cast on the question shall be allowed a recount pursuant to this section by filing with the secretary of state a request for a recount stating that the person or the person’s position on a question was defeated by less than one percent of the votes cast. Such request shall be filed not later than seven days after certification of the election. The secretary of state shall notify all concerned parties of the filing of the request for a recount. The secretary of state shall authorize the election authorities to conduct a recount pursuant to this section if the requesting party or his position on a question was defeated by less than one percent of the votes cast. The secretary of state shall conduct and certify the results of the recount as the official results in the election within twenty days of receipt of the aforementioned notice of recount.
  4. Whenever a recount is requested pursuant to subsection 3 of this section, the secretary of state shall determine the number of persons necessary to assist with the recount and shall appoint such persons equally from lists submitted by the contestant and the opponent who received more votes or a person whose position on a question received more votes than the contestant’s position on that question. Each person appointed pursuant to this section shall be a disinterested person and a registered voter of the area in which the contested election was held. Each person so appointed shall take the oath prescribed for and receive the same pay as an election judge in the jurisdiction where the person is registered. After being sworn not to disclose any facts uncovered by the recount, except those which are contained in the report, the contestant and the opponent who received more votes or a person whose position on a question received more votes than the contestant’s position on that question shall be permitted to be present in person or represented by an attorney at the recount and to observe the recount. Each recount shall be completed under the supervision of the secretary of state with the assistance of the election authorities involved, and the persons appointed to assist with the recount shall perform such duties as the secretary of state directs. Upon completion of any duties prescribed by the secretary of state the persons appointed to assist with the recount shall make a written and signed report of their findings. The findings of the persons appointed to assist with the recount shall be prima facie evidence of the facts stated therein, but any person present at the examination of the votes may be a witness to contradict the findings. No one other than the secretary of state, the election authorities involved, the contestant and the other witnesses described in this subsection, their attorneys, and those specifically appointed by the secretary of state to assist with the recount shall be present during any recount conducted pursuant to this section.
  5. For purposes of this section, “recount” means one additional counting of all votes counted for the office or on the question with respect to which the recount is requested.

What keeps YOU from attending Gasconade County Commission Meetings?

During 2009 and 2010, I have attended a number of meetings of the Gasconade County Commission.  I've seen enough of these meetings to last me a lifetime.  I've come away with a certain impression regarding how our county is being managed.  And the impression I have taken away is not good!

I am always disappointed that more citizens don't take the time to attend these meetings.  I mean how can you know how to vote for county officials if you don't observe their performance first-hand?  Unfortunately these meetings are poorly attended.  And that's not good for Gasconade County!

Have you ever attended a Gasconade County Commission Meeting?  Why haven't you?  Afterall, you employ the County Commissioners and the County Clerk!  They work for you!  Your tax money pays their salaries and benefits?  So why don't you attend their meetings to judge first-hand how they are managing the affairs of the county?
  • Are you concerned that YOU will become the focus of the story in the local media IF you dare to ask a penetrating though legitimate question about the county's affairs? 
  • Are you concerned that YOU will have your photo taken and that you will be portrayed  as some kind of wild-eyed lunatic instead of the concerned taxpayer which you really are?
  • Are you concerned that YOU might be ejected from the meeting if you should dare disagree with the Presiding Commissioner and speak your mind?
  • Are you concerned that YOU might be labeled a "gangsta rapper" by a certain high-and-mighty political pundit and provocateur who happens to write forum articles for one of our local online "news" websites?
  • Are you concerned that YOU might be called a "lieing [expletive]" or a "d*&%head" by the Southern District Associate Commissioner or by his son?
  • Are you concerned that YOU might be chest-bumped and otherwise goaded into a physical confrontation by another meeting attendee?
  • Are you concerned that YOU might be "ambushed" during the commission meeting in a well-orchestrated attempt to embarrass and discredit you?  Trust me, it has happened.  And it is likely to happen again!
  • Are you concerned that YOU might not be able to get a seat at the meeting?  The Commission meets in a very small room in the courthouse, so seating capacity IS very limited.  But, if a large group of citizens shows up for the meeting, the Commissioners can elect to move the meeting to one of the courtroom when court is not in session.
  • Are you just bored out of YOUR mind by the slow-pace and disorganized flow of the meeting?  I have to admit, it's a big waste of time to watch the Presiding Commissioner shuffle papers as though it is the first time he has seen them!  Do you wonder where the real business of the county is conducted?  I have to admit that I wonder about this all the time.  Do you wonder about the trivial matters that are discussed in the meeting?  I do.  Do you wonder why bigger issues (county budget, courthouse preservation and restoration, road improvement priorities, etc.) are not discussed more often in the public meetings?  I do.
IF you are concerned and put off by things such as these, then it just might explain why you stay away from these public meetings.  But let me ask you something ..... Are you going to allow these forces to conspire to intimidate you from getting involved in the county's business?  Are you going to allow your public servants and the people who purport to report the local "news" scare you away from public county meetings held in county owned public facilities?

If you can't attend the meetings because they are held at an inconveniet time, then at least tune-in to Hermann's public cable TV station.  Those who aren't on the Hermann cable system can get copies of the video tapes (for a nominal fee) at the city adminstrative office.  And if you can't do any of these things, then at least read the County Commission Meeting Minutes which are printed each week in both The Hermann Advertiser-Courier and the Gasconade County Republican.

Editorial Comment: "Gangsta Hanksta" gets it wrong once again!

Political pundit and provocateur "Gangsta Hanksta" has it ALL figured out!  Just ask him!  He recently proclaimed the reasons for Ron Jost's narrow victory over Larry Miskel for Republican nominee for the office of Gasconade County Presiding Commissioner.  As is so often the case, "Old Hank" is wrong again.

My take on the results of the August 3rd election differs from Hank's.  I say this:

  • Jost won by 16 votes (maybe).  16 votes out of a total of 2788 votes cast ..... a slight margin of only 0.57%.   Nothing much there to crow about!  And what would a 100% manual recount of all votes cast have yielded?  We will never know.  Yet, "Old Hank" seems to be crowing anyway!
  • Jost won because of the low voter turnout of approximately 30% county-wide.  I don't understand the voter indifference!  If the voters couldn't get excited about the race for Presiding Commissioner, I don't know what they can get excited about!
  • Matt Penning's interview with HermannNEWS.com had little if anything to do with the election results. The Penning video interview by HermannNEWS.com reporter Anna Wiegenstein was posted on August 2nd (one day prior to the election) and remained posted on HermannNEWS.com for ONLY one day.  The last I remember it had only been viewed by just a handful of readers prior to election day.  Today (8/29) the three-part interview remains posted at YouTube.com.  The YouTube view counts are as follows:  Part 1 - 179 views, Part 2 - 129 views, and Part 3 - 99 views.  Nice try "Hanksta", but I seriously doubt whether Penning's video-taped interview factored into the election results one way or the other.  I only regret that the three-part video-taped interview wasn't posted on HermannNEWS.com a couple weeks earlier when it was originally recorded.
  • This was Larry Miskel's first run for a county-wide office.  He ran against a two-term incumbent. IF Miskel runs again, he will win!  IF he and those of us who supported him had campaigned just a little bit harder, he would have won this time!
